Maxiphone service provision procedure (enters into force on October 06, 2014)
1.1. This document determines relations procedure between Republican Unitary Telecommunication Enterprise Beltelecom (hereinafter referred to as “Operator”) and legal entities, individuals, as well as individual entrepreneurs (hereinafter referred to as “Subscribers”) using the service “Maxiphone” (hereinafter referred to as “Service”) provided by the Operator.
1.2. The Service is provided by the Operator under the License No. 02140\487 of 20.08.2004 issued by the Ministry of Communications and Informatization of the Republic of Belarus.
1.3. The Service is provided on contract basis.
1.4. The Service does not present potential hazard to people’s live, health and heredity, property and environment.
1.5. The Operator notifies a Subscriber about all amendments introduced into the telecommunications services agreement (hereinafter referred to as “Agreement”) and in the tariffs set by a tariff plan by placing the relevant information on the official website www.beltelecom.by, containing text of amendments or information source.
1.6. The Operator notifies a Subscriber about raising of the published tariffs no later than 10 days before entry of amendments.
The following terms with the following definitions are used in this document:
“Subscriber” shall mean an user of telecommunications services, with whom the telecommunications agreement is concluded, when providing subscriber’s number and unique identification code for these purposes.
“Subscriber’s number (login)” shall mean information provided to a Subscriber by the Operator into the use, when entering the Agreement (Maxiphone Service Provision Annexes), and identifying a Subscriber, when using the Service.
“Subscriber’s terminal” shall mean Subscriber’s user equipment (PC, smartphone) with the installed Application “Maxiphone”, providing access to Operator’s Service by connecting this equipment to Internet.
“Authentication data” shall mean Subscriber’s unique login and password allocated by the Operator to a Subscriber to access the Service.
“Operator’s billing system” shall mean Operator’s automated system used for record by the Operator of operations connected with services provision to a Subscriber.
“User account” shall mean Operator’s service, enabling a Subscriber to control the status of Subscriber’s User account in Operator’s billing system, connect and disconnect additional services. User account is available in Internet at https://issa.beltelecom.by.
Service control functions, available via “User account”:
- display information about the status of Subscriber’s ledger account;
- display information about cost of services;
- display information about payments;
- order additional services (“Musical Marathon”);
- replenish ledger account balance via prepaid cards activation or registration of a promised payment;
- change a tariff plan.
- Change of a tariff plan. Change of the tariff plan “Vygodny” to the tariff plan “Svobodny” is available at least 30 (thirty) days after the date of activation or previous change of a tariff plan. Change of the tariff plan “Svobodny” to the tariff plan “Vygodny” is available without any time limit.
“Ledger account” shall mean an analytical ledger in Operator’s billing system designed for reflection of operations of telecommunication services provision to a Subscriber and payments accrual.
“Musical Marathon” shall mean the service, enabling a Subscriber to replace a standard dial tone signal for incoming calls from different networks to melodies or phrases.
“Elite number” shall mean the service, enabling a Subscriber to choose a number from the list of available subscriber numbers of Maxiphone Service.
“Operator” shall mean Republican Unitary Telecommunication Enterprise Beltelecom.
“Promised payment” shall mean Operator’s service, enabling a Subscriber to replenish a ledger account without performing a real payment to the Operator.
“Password” shall mean a confidential set of digits and/or symbols and/or Latin letters designed for identification of a Subscriber in Maxiphone Application.
“Maxiphone Application” shall mean the application, enabling a Subscriber to receive an access to the Service via a PC/laptop or a smartphone. The Application allows a Subscriber to make phone calls, videocalls and send instant messages.
“Tariff plan” shall mean a set of price terms, whereon the Operator offers to use one or several Services.
“Maxiphone Service” shall mean a telematic service, combining IP telephony service and instant messaging.
“Subscriber full access account” shall mean a record in the Service platform database, containing information about a Subscriber, including, but is not necessary is limited to Subscriber’s number (Login) and Password.
“Compulsory blocking” shall mean suspension by the Operator of telecommunications services provision to a Subscriber in case of insufficient means on Subscriber’s Ledger account.
3.1. The Service includes:
3.1.1. feasibility to use (with Maxiphone Application) the following functions:
- make phone connections with subscribers of the Service, subscribers of local telephone network, as well as make long distance and international connections, including with cellular mobile telecommunications subscribers;
- make video connections with subscribers of the Service, subscribers of Operator’s IMS network, using a video telephone as Subscriber’s terminal;
- make voice connections with the services 123, 130, 153, 109.
3.1.2. feasibility to use additional services:
- “Musical Marathon”;
- “Elite number”;
- “Number replacement” is performed:
- if initiated by a Subscriber - a fee is charged, the amount of the fee is established by the Operator;
- if initiated by a Operator (free of charge), if provision of the Service using previously allocated number is impossible due to technical difficulties. In this case, the Operator shall notify a Subscriber hereof, indicating the reason and date of replacement, new subscriber’s number, no later than 30 days before the upcoming replacement;
- changing a surname, name, patronymic name by a Subscriber;
- changing a name or current account by a legal entity or reorganization of a legal entity by virtue of a notice;
- filing of application by a Subscriber on provision of the right to use subscriber’s number to a third party;
- death of a Subscriber - Subscriber’s family members have the preferential right.
- “Detailed Bill”;
3.2. The Service does not includes:
- making calls to the numbers of emergency services and the numbers of inquiry services (except for 123, 130, 153, 109);
- provision of Internet access services;
- changing the list of open and/or closed communication directions.
4.1. The Service is provided under the terms of the concluded Agreement and Maxiphone Service Provision Annex, being an integral part of the Agreement.
4.2. Consultations regarding the Service and contractual relations are performed at Operator’s Sale services.
4.3. Service provision is executed by signing with a Subscriber an Agreement and Service Provision Annex.
4.4. The Agreement and Annex define mutual rights and obligations of Operator and Subscriber.
4.5. The Agreement and Service Provision Annexes signing procedure is fulfilled pursuant to regulatory requirements of the operator and in accordance with the legislation of the Republic of Belarus.
4.6. Maximum 5 (five) subscriber’s numbers can be allocated to a Subscriber (an individual) under the terms of the Agreement.
4.7. When entering contractual relations for a tariff plan with a subscription fee, a Subscriber shall make an initial payment in the amount of at least equal a monthly subscription fee of a chosen tariff plan.
4.8. Operator has the right to reject providing the Service to a Subscriber (allocating new Maxiphone subscriber’s numbers) in the following cases:
- availability of outstanding debts in payment for the Service (on previously allocated subscriber’s numbers, including blocked numbers);
- violation (single) by a Subscriber of the clause 8.4. of this Service Provision Procedure.
4.9. Maximum 4 (four) subscriber’s numbers can be allocated to a Subscriber (individual entrepreneur) under the terms of the Agreement.
5.1. In order to get access to the Service a Subscriber uses Authentication Data (login and password), the confidentiality of which is ensured by a Subscriber individually.
5.2. he following activities of a Subscriber are prohibited:
- the usage of authentication data, not assigned under the Agreement, in order to get access to the Service, as well as dissemination of the assigned authentication data (including the transfer to any third party) by any means;
- the usage of authentication data of a third party in order to get access to the Service, as well as dissemination of such data in generally available Internet resources.
5.3. A Subscriber is personally liable for all actions committed under subscriber’s Authentication data within the Service scope.
5.4. The Operator is not liable for Subscriber’s misconduct committed when using Operator’s Services under the Subscriber’s Authentication Data.
5.5. Service access password can be changed by a Subscriber individually via User account at https://issa.beltelecom.by (section Tariffs and services/Ordered services) or through applying to Operator’s Sales service.
5.6. Password recovery (if a Subscriber forgot the password) is not carried out by the Operator.
6.1. Access to the Internet is required to use Maxiphone Application.
6.2. Maxiphone Application runs on the following operating systems:
6.2.1. For PC: Windows 7, Windows Vista, Windows XP;
System requirements for Windows operating system:
- CPU at least 2,0 GHz;
- at least 1 GB RAM and 30 GB free space on hard disk;
- access to the Internet;
- viewing system with the number of matrix pixels at least 0.3 megapixels.
6.2.2. For mobile phones: Android version at least 2.2.
System requirements for Android operating system:
- RAM at least 512MB;
- access to the Internet;
- viewing system with the number of matrix pixels at least 0.3 megapixels.
The list of devices with technical parameters recommended for the installation and usage of Maxiphone Application in accordance with the results of testing is available on the website of the Operator www.beltelecom.by.
6.3. The installation of Maxiphone Application on a Subscriber’s device is carried out individually.
6.4. Internet access parameters enough for:
- voice massage transmission: minimum speed in each direction 100 Kbps, maximum 150 Kbps;
- messaging: minimum speed in each direction 64 Kbps;
- video message transmission: minimum speed in each direction 484 Kbps, maximum 640 Kbps.
6.5. The Operator ensures the Service operation when using Maxiphone Application.
6.6. In order to use all the advantages of the Service Subscriber’s terminal is to have a microphone, dynamics and a camera.
6.7. Maxiphone Application is available for download and installation:
- for Windows operating system on Operator’s website http://www.beltelecom.by/maxifon-1 and http://www.beltelecom.by/maxifon-0;
- for Android operating system in AppStore GOOGLE Play, and on Operator’s website http://www.beltelecom.by/maxifon-1 and http://www.beltelecom.by/maxifon-0;
7.Internet traffic volume consumed by Maxiphone Application, while making voice and video connections is not stable and depends on the Internet access speed (both of a calling and a called subscriber) and conversation intensity. Thus, traffic can vary depending on different conditions of massage transmission. The average volume of traffic during the transmission of voice massages is approximately 500 KB/minute, during video massages transmission– 5MB/minute.
7.2. Internet traffic volume consumed by Maxiphone Application in background mode:
- for Android operating system: 0,8~1,2 MB/per 12 hours;
- for Windows 7, Windows XP operating systems: 3~4 MB/per 12 hours.br>
7.3. Files transmission is available only when using Maxiphone Application versions for PC.
7.4. he size of a file transmitted (.doc, .docx, .xls, .xlsx, .txt, .pdf, .vsd) is to be not larger than 20MB, images (.png, .gif, .jpg, .tif, .bmp) – not larger than 5MB.
7.5. The size of a text massage is limited to 512 symbols. A Subscriber will receive a massage in case of exceeding the number of symbols allowed.
7.6. The multiplayer chat will be compulsory closed by Maxiphone Application, when subscribers are inactive during 5 minutes.
7.7. In case of Internet access failure of one of Subscribers of the multiplayer chat, the chat is compulsory closed by Maxiphone Application.
8.1. The Service is available for a Subscriber from 00:00 of the date, specified in Service Order to Service Provision Annex (if a Subscriber makes an order for the provision of the service with a delayed date of activation). If the service activation date coincides with the date of Service Order signing – the Service is available from the moment of signing.
8.2. The Service is available 24 hours, 7 days a week.
8.3. Termination of access to the Service is carried out on the date specified in the Subscriber’s application.
8.4. The following activities of a Subscriber are prohibited, when using the Service:
- the usage of the Service for commercial purposes;
- the usage of any software in order to receive remote access to devices, which use the Service;
- the usage of any software and/or software settings in order to change IP-addressing (proxy);
- the usage of vulgar language on the Website of the Operator (chats, forums, etc.);
- the usage of vulgar language in e-mails and conversations with employees of the Operator.
If the abovementioned restrictions are violated or the Operator believes, that a Subscriber has violated the restrictions causing damage to the Operator, third parties or the state, the Operator reserves the right to terminate the Service provision without a prior notice to a Subscriber. If a Subscriber does not apply to the Operator for the Service access restoring within 30 days after service provision termination, the Operator dissolves Service Provision Annex on a unilateral basis. Subscriber’s number is blocked for the period of 180 days, there after it can be provided to another Subscriber. The right of preferential usage of previously assigned subscriber’s number does not extend to such Subscribers.
8.5. Tariff change is carried out after at least 30 (thirty) days from the date of activation or previous tariff plan change.
Services Payment is carried out by a Subscriber in accordance with the terms and conditions determined by the contractual relations, the Procedure and tariffs accepted by the Operator.
9.2. The following forms of payment are applied:
- credit form of payment and pre-payment – for legal entities and individual entrepreneurs (residents of the Republic of Belarus);
- pre-payment – for legal entities and individual entrepreneurs (who are not residents of the Republic of Belarus);
- pre-payment – for individuals (citizens of the Republic of Belarus and other states).
9.3. Money withdrawal from Subscriber’s ledger account is carried out in accordance with the terms and conditions of the tariff plan chosen.
9.4. Individuals choose methods of payment for Services (replenishment of a ledger account) individually among the following available options:
- cash payment;
- cashless payment, including bank cards;
- express payment cards;
- virtual express payment cards.
9.5. he duration of connection used to determine the amount of payment for traffic is determined from the first second after the answer of the called party (or the corresponding equipment) till the moment of the termination by the calling or called party (or the corresponding equipment).
9.6. A tariffication unit is considered to be the duration of connection a Subscriber is charged for which equals to the tariff established for this type of connection.
9.7. The cost of connection is determined on the basis of its duration multiplied by the tariff.
9.8. The Operator does not make a compulsory disconnection. If during connection the Subscribers of the Service (or one of the Subscribers of the Service) have difficulties with Internet access (disconnection, loss of packages, decrease in the signal level of wireless network), such connections are charged in full extent, fixed by Operator's billing system.
9.9. The tariffication of the connection made by a Subscriber is carried out by Operator’s billing system after its termination.
9.10. The tariffs for the Service do not include provision of Internet access services.
9.11. A Subscriber independently monitors the status of the ledger account via User account, available on the website http://issa.beltelecom.by.
9.12. A Subscriber shall determine the amount of ledger account replenishment individually.
9.13. The peculiarities of charges, when using advance payment.
9.13.1. The Operator does not make a compulsory disconnection, when there is a positive balance on a ledger account, the amount of which is less than the cost of the connection at the moment the connection is made.
9.13.2. A subscription fee, including for additional services, is charged off from a ledger account on a daily basis in equal installments over the period of the Services provision. The amount to be charged off is calculated on the basis of the tariff divided by the number of days in the current month.
9.13.3. The payment for number conservation is charged off from Subscriber's account on a one-time basis on the first day of each subsequent month, if there were no paid connections registered from Subscriber’s number in the previous month. The exception is the month in which the Service is activated. During this month, irrespective of the Service activation date, the payment for number conservation is not charged.
9.13.4. A Subscriber has access to the service Promised payment. The registration of a promised payment is made by a Subscriber via User account. The maximum amount of a promised payment is 35 000 BYN. If during three days from the date of the order of the service Promised payment a Subscriber does not confirm it with real payment, the amount of the promised payment is charged off from Subscriber’s ledger account. A Subscriber can use the service Promised payment again only after the payment of the outstanding debt.
9.13.5. When a ledger account balance is zero or negative, the Operator compulsory blocks only outgoing connection (incoming connection is available, including the connection made outside the territory of the Republic of Belarus).
9.13.6. A Subscriber is not exempt from the subscription fee for a period of temporary termination of access to the Service due to a zero or negative ledger account balance (compulsory blocking). The subscription fee is charged before the end of the current calendar month. From the beginning of a new calendar month till the date of the renewal of the Service provision the subscription fee is not charged. The access to the Service is allowed after the replenishment of Subscriber’s ledger account to form a positive account balance.
9.13.7. The term of compulsory blocking of the service shall not exceed 60 days. After the specified period of time, the Operator terminates Service Provision Annex on a unilateral basis. Subscriber’s number is blocked for the period of 180 days, thereafter it may be provided for use to another Subscriber. Within 180 days, a Subscriber may apply to the Operator for conclusion of a new Service Provision Annex, using Subscriber’s number assigned in accordance with the previously concluded Agreement.
9.14. The peculiarities of charges, when using credit payment.
9.14.1. A subscription fee, including for additional services, is charged off from a ledger account on a daily basis in equal installments over the period of the Services provision. The amount to be charged off daily is calculated on the basis of the tariff divided by the number of days in the current month.
9.14.2. Payment for number conservation is charged off on a one-time basis in Operator’s billing system, if there were no paid connections registered from Subscriber full access account in the previous month. The exception is the month in which the service is activated: if in the month of the activation there are no paid services registered on Subscriber full access account, the payment for number conservation is not charged.
9.14.3. In case of delay in payment specified in the concluded Service Provision Annex, the Operator blocks only outgoing communication. The subscription fee is charged off before the end of the current calendar month. From the beginning of a new calendar month till the date of the renewal of the Service provision the subscription fee is not charged (incoming connection is available, including the connection made outside the territory of the Republic of Belarus).
9.14.4. The term of the Service blocking due to outstanding debts shall not exceed 60 days. After the specified period of time, the Operator terminates Service Provision Annex on a unilateral basis. Subscriber’s number is blocked for the period of 180 days, thereafter it may be provided for use to another Subscriber. Within 180 days, a Subscriber may apply to the Operator for conclusion of a new Service Provision Annex, using previously assigned Subscriber’s number.
9.14.5. The access to outgoing communication is terminated in case of delay in payment on time, specified by the terms of Service Provision Annex.
9.14.6. A Subscriber is not exempt from the subscription fee for a period of temporary termination of access to the Service due to outstanding debts (financial blocking). From the beginning of a new calendar month till the date of the activation the subscription fee is not charged. The access to the service is renewed after the outstanding debt repayment.
9.15. The peculiarities of charges for the tariff plan with telephonThe volume of telephone traffic included in the tariff plan is metered for the period from the first till the last day of a calendar month.
9.15.2. If provision of the Service is started not on the first day of a calendar month, the whole volume of traffic stipulated by the tariff plan is provided to a Subscriber from the activation date of the tariff plan (connection) till the end of the calendar month.
9.15.3. The unused volume of traffic included in the tariff plan is not summed up and is not transferred to the next month.
9.15.4. The entire volume of telephone traffic exceeding the volume included in the tariff plan is charged according to the applicable tariffs.
9.15.5. The information on the volume of traffic consumed by a Subscriber in the current calendar month is available via User account on the website: https://issa.beltelecom.by in the Section Statistics / Subscriber’s meter.
10.1 The Operator has the right to collect and process personal data of a Subscriber, which, inter alia, may include the following information:
- identification information (nickname, name and surname, address, Subscriber’s number, e-mail, ect.);
- personal data from Subscriber’s Questionnaire (age, sex, country of residence and other information specified by a Subscriber during the registration in the Service voluntarily);
- Subscriber's contact list;
- traffic data processed for the purpose of communication or billing of the services, including data on duration of a call and nuAll Subscriber’s information is provided by a Subscriber voluntarily. By changing the setting of Questionnaire data display, a Subscriber can choose which information will be visible to other Subscribers of the Service. A Subscriber can change the information in Maxiphone Annex Questionnaire.
10.3. The Operator shall be obliged not to provide third parties into the use and otherwise transfer Subscriber's personal data and / or traffic data or the content of Subscriber’s calls, if only the transfer of Subscriber’s personal data to the third parties does not contradict the legislation of the Republic of Belarus or is not caused by the requirements of the authorized units.
11.1. The Operator plans and performs periodic testing, adjustment and repair of the equipment necessary to ensure the quality of the Service.
11.2. Subscribers’ technical support service functions on the basis of Operator’s telephone services.
11.3. A subscriber can apply to the technical support service by the phone number 123.
12.15. When the Operator fails to fulfill or improper fulfills the terms stipulated in the Agreement and Service Provision Annex, a Subscriber is entitled to submit a reclamation to the Operator.
12.16. The procedure for submission and consideration of a reclamation is stipulated in the Agreement and Service Provision Annex.
12.17. The disputes arising under the Agreement, which can not be settled by negotiations, as well as by claims considering procedure, should be settled in courts in accordance with the legislation of the Republic of Belarus.
13.15. The Procedure is established by the Operator at sole discretion.
13.16. The Operator has the right to make amendments/supplements in the present Procedure by publishing notices of amendments/supplements on Operator’s web-site http://www.beltelecom.by.
13.17. The Procedure shall come into force since its approval by the Operator.
